Hungry Jack’s is yet to file a defence after McDonald’s backlash, claiming the rival “deliberately adopted or imitated” the famous Big Mac burger.
But Hungry Jack’s has made a cheeky dig at its rival in a new TV ad.
A voiceover in the ad for the Big Jack says: “They reckon Aussies are confusing the Big Jack with some American burger. But the Big Jack is clearly bigger with 25 per cent more Aussie beef, flame grilled with a barbecue taste.”
McDonald’s claims the Big Jack burger is “likely to deceive or cause confusion” among its consumers since its rival has been promoting the new burger in Australia since July.
In a federal court filing, McDonald’s has asked the court to restrain Hungry Jack’s from using its new trademarks or any others that are “substantially identical or deceptively similar” to McDonald’s trademarks, and for an order cancelling the Big Jack trademark.

The fast food chain is also seeking damages, interests and costs as well as an order that Hungry Jack’s destroy all “promotional materials, including physical and electronic brochures, menus, advertising and marketing materials, stationery, signage, packaging and documents” using the Big Jack trademarks.
“Hungry Jack’s is bemused by the trademark lawsuit filed against it in the Federal Court,” a Hungry Jack’s spokseperson commented. “This is without basis.
